MIDLAND FARM TERMS AND CONDITIONS
The Owners are Sarah and Charles Smith of Midland Farm, Norton Canon, HR4 7BP, (hereafter referred to as the ‘Owners’).
The Property consists of The Grey Goose and The Greedy Gander (hereafter referred to as the “Property”).
It is a condition of staying at The Property that guests agree to and abide by these terms and conditions.
1. Booking and payments
1.1 The costs of The Grey Goose and The Greedy Gander are shown on the Owners web site at www.midlandfarm.co.uk
There is a minimum stay of two nights unless agreed first in writing via email by the Owners.
1.2 The Greedy Gander sleeps up to a maximum of four people in a double and two single beds.
The Owners’ permission must be obtained in writing via email at the time of the booking for more than four guests.
The Grey Goose sleeps a maximum of two people in a double bed.
1.3 Stag nights and hen nights are not catered for.
1.4 All bookings must be paid in full at the time of booking.
1.5 On receipt of payment a booking confirmation will be sent to you via email.
If you have not received your booking confirmation within reasonable time, please notify us as soon as possible by emailing firstname.lastname@example.org .
1.6 Check-in is from 4.00pm on the day of arrival and check-out is by 10.00am on the morning of departure.
2.1 We will refund the full cost of your booking if you cancel more than 10 weeks before your check-in date.
2.2 Bookings are non-refundable if you cancel within 10 weeks of your check in date.
2.3 If the location of your booking becomes inaccessible due to adverse weather or unforeseen circumstances the Owners reserve the right to defer your booking to a later date subject to availability and at discretion of the Owners.
3.1 Alterations to your booking can only be made more than 10 weeks prior to the check in date, after which time alterations will be treated as a cancellation. All alterations are subject to availability and at the discretion of the Owners.
3.2 Differences in the total amount payable resulting from alterations will be refunded to you in the case of a decrease in price and paid by you in the case of increases in price.
In the event that you have a complaint during your stay please notify The Owners directly in person as soon as possible during your stay.
The Owners cannot address issues raised after you have checked out.
The Owners will use all reasonable endeavours to resolve any issue.
Prices on websites, including the Midland Farm site, are subject to error and are not binding. The costs stated in the booking confirmation email you receive from the Owners is binding and will be honoured as shown.
Information on the Midland Farm website is correct to the best of The Owners knowledge, but the Owners cannot guarantee its accuracy.
7. Loud music
Please do not play music outside during your stay. Music played inside must be at a reasonable volume that does not interfere with the Owners or other guests. The Owners will be the sole arbiters of what is a reasonable volume. Guests that do not adjust the volume as requested will be asked to leave.
No pets are permitted at The Property.
9. Damage to the property
All damage to the Property and its contents must be reported to The Owners at the time it takes place and paid for in full.
10.1 The Owners accept no liability for accident, loss of property or personal injury whilst on your stay.
10.2 The Owners will not be liable for any act, neglect or default on the part of the Owners or any other person not within their employ or otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the Guest or any other person may suffer or incur arising out of, or in any way connected with the rental. In addition, the Owners accept no liability for loss of or damage to the Guest’s possessions on the Owners’ property or land.
10.3 The use of hot tubs, barbeques and all other facilities and activities at the Property and on the Owner’s land is the responsibility of all guests and is done so at their own risk.
11. Your Stay – Conditions of occupancy and Conduct
11.1 You have the right to occupy the Property for the paid for holiday period only (within the meaning of Schedule 1 Paragraph 9 of the Housing Act 1988).
Check-in is from 4.00pm on the day of arrival and check-out is by 10.00am on the morning of departure.
11.2 You undertake to behave in a proper, appropriate and legal manner with due respect to the Owners, the Property and other guests and their property.
If any guest behaves inappropriately or improperly (of which the Owners will be the final judge), or illegally, the Owners reserves the right to demand the guest and all their party leave the Property before the end of their stay.
Any refund for being asked to leave early will be at the entire discretion of the Owners. In addition, the Owners reserves the right to sue the guest for any loss, damage or injury caused to the Owners, the Property or to other guests and/or their property.
12. Breach of Terms and Conditions
12.1 If there is a breach of any of these conditions by any guest the Owners reserve the right to re-enter the Property and end the holiday and ask the Guest and their party to leave in addition to their other rights specified in these terms and conditions.
12.2 Ending the booking by the Owners does not affect the Owners other rights and remedies.
13. Governing Law and Jurisdiction
Any dispute will be governed by the non-exclusive law and jurisdiction of the English or Scottish Courts depending on the location of the Property.
14. Authority to Sign
The person who pays for the booking certifies that:
he or she is authorised to agree these Terms and Conditions on behalf of all persons staying, including those substituted or added at a later date;
the signatory is over eighteen years of age;
they agree to take responsibility for the party occupying the Property, and to notify the Owners if they are not a member of the holiday party.
In case of a discrepancy between these Booking Conditions and any other literature, these Booking Conditions shall prevail.
16. Validity clause
In the event that a court finds that a condition in these Terms and Conditions are illegal or void, the illegal or void provision will be severed from the remainder of the Terms and Conditions which will continue to be valid and have full force and effect.
